PortraitBrush respects intellectual property rights and will respond to clear notices of alleged copyright infringement under the United States Digital Millennium Copyright Act (DMCA). This page explains how copyright owners can submit a Takedown Notice and how users can submit a Counter Notice.

2) What this policy covers

This policy applies to content hosted on portraitbrush.com and official PortraitBrush pages. It is intended for copyright issues. For trademark or other legal concerns, contact us at the same email with a clear description.


3) Before you file

• Make sure you are the copyright owner or authorized to act for the owner.

• Check whether the use might be fair use, licensed, or otherwise permitted.

• Submitting a false or bad-faith notice may have legal consequences under 17 U.S.C. § 512(f).


4) How to submit a DMCA Takedown Notice

Send your notice to our DMCA Agent. To be valid under 17 U.S.C. § 512(c)(3), your notice must include:

• Your contact information: full name, organization, mailing address, telephone, and email.

• Identification of the copyrighted work you claim has been infringed. You may list multiple works.

• Identification of the material you claim is infringing or the subject of infringing activity that is to be removed or disabled, including the exact URL or location on our site so we can find it.

• A statement that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law.

• A statement that the information in your notice is accurate, and under penalty of perjury, that you are the copyright owner or authorized to act for the owner.

• Your physical or electronic signature. Typing your full legal name at the end of the notice is acceptable.

We will review your notice and take appropriate action, which may include removing or disabling access to the material and notifying the user who posted it.


5) Notification to the user and Counter Notice

If your content was removed because of a DMCA notice, you may submit a Counter Notice to request restoration. To be valid under 17 U.S.C. § 512(g)(3), your Counter Notice must include:

• Your contact information: full name, mailing address, telephone, and email.

• Identification of the material that was removed or disabled and the location where it appeared before removal.

• A statement under penalty of perjury that you have a good faith belief the material was removed or disabled as a result of mistake or misidentification.

• A statement that you consent to the jurisdiction of the Federal District Court for the judicial district of your address, or if outside the United States, the judicial district where PortraitBrush may be found, and that you will accept service of process from the person who provided the original notice or that person’s agent.

• Your physical or electronic signature.

After we receive a valid Counter Notice, we will forward it to the original complainant. We may restore the material in 10 to 14 business days unless the complainant informs us that they have filed a court action seeking to restrain the user from engaging in infringing activity.


6) Repeat infringer policy

PortraitBrush may suspend or terminate accounts of users who are determined to be repeat infringers. We also reserve the right to remove content and disable access at our discretion when we believe infringement has occurred.


7) Use of customer photos

Customers must upload only photos they own or have permission to use. By uploading, you confirm you have the necessary rights for us to create your custom artwork. This requirement is also described in our Terms of Service.


8) Sharing of notices

To process your claim, we may share the contents of your notice or Counter Notice with the involved user and with our service providers. We may also include your notice in our legal records.
