Welcome to PortraitBrush. By placing an order, using our website, or receiving any of our products or services, you agree to the terms below. If you do not agree, please do not use our services.

1) About PortraitBrush

PortraitBrush creates custom, hand-drawn portraits from the photos you provide. We send a digital preview for your approval before printing. We ship worldwide with tracking.

2) Eligibility

You must be at least 18 years old, or use the site under the supervision of a parent or legal guardian.

3) Your Photos and Permissions

You confirm that you own the photos you upload, or you have permission from the rights holder to use them for a custom portrait.

You grant PortraitBrush a limited, non-exclusive license to use your uploaded content only to design, produce, and deliver your order, to provide customer support, and to meet legal obligations.

We do not use your photos or final artwork in marketing unless you explicitly consent in writing.

4) Artwork Process, Approvals, and Revisions

Preview in 8 hours: after you place an order, an artist hand-draws your portrait and sends a digital preview within about 8 hours.

Unlimited revisions: request free edits until you are 100% happy.

No auto-approval: we only print after you approve the preview.

Production: once approved, production typically takes 1 to 3 business days.

5) Cancellations

You can cancel within 4 hours of placing your order. We begin the custom drawing about 1 hour after purchase.

After 4 hours, cancellation is not possible because work has started, but you still control printing. If you decide not to approve your preview, you may request a full refund before printing.

6) Returns, Refunds, and Replacements

Before printing: you may request a full refund if you choose not to proceed after preview and revisions.

After approval or printing: because each piece is custom made, returns and refunds are not accepted.

Damaged or misprinted items: if your order arrives damaged, misprinted, or not as approved, email us within 7 days with photos. We will replace the item at no charge.

Digital files: once the digital file has been delivered, it is non-refundable.

7) Shipping, Delivery Times, and Rates

We ship worldwide with tracking. Delivery times after approval are typically:
USA 2–5 business days, UK/Europe 5–9 business days, Canada/Australia 7–11 business days, Rest of World 7–14 business days.

Rates (USD) are based on the largest physical item in your cart. Free shipping on orders over 100 USD after discounts, before taxes.

     • United States: Digital file free. Poster only and frames under 12×16 in: $7. Frames 12×16 in and larger: $15.

     • International: Digital file free. Poster only and frames under 12×16 in: $15. Frames 12×16 in and larger: $30.

Delivery estimates can vary by location, carrier, and seasonal volume. International orders may incur duties and taxes charged by the destination country; these are the recipient’s responsibility.

8) Pricing, Payments, and Taxes

Prices are shown in USD unless noted. We accept major cards and PayPal. Installment options may be available at checkout in some regions.

You authorize us to charge your selected payment method for the full order amount, including shipping, taxes, and any options you select.

Promotional pricing, discounts, and free-shipping thresholds may change at any time.

9) Digital File License and Personal Use

When you purchase a digital file, we grant you a personal, non-exclusive, non-transferable license to download, store, print for yourself or for gifting, and share on your personal social media.

Commercial use, resale, reproduction for sale, or use in advertising is not permitted without a written commercial license from PortraitBrush.

10) Intellectual Property

The PortraitBrush website, brand, templates, layouts, artwork styles, and all related materials are protected by copyright and other intellectual property laws.

You retain rights in your original photos. PortraitBrush retains rights in its artwork, designs, and styles, subject to the personal-use license above.

11) Accuracy of Information and Color Disclaimer

We try to present sizes, materials, and colors accurately. Minor color variations can occur between on-screen images and printed items due to display calibration and print processes. This is not considered a defect.

12) Prohibited Content

You agree not to upload content that is illegal, infringing, hateful, harassing, obscene, or that violates privacy or publicity rights, trademarks, or copyrights. We may refuse an order that violates these rules.

13) Accounts, Security, and Communications

If you create an account, you are responsible for maintaining its confidentiality. We may contact you by email regarding orders, approvals, and shipping updates. For information on how we collect and use data, see our Privacy Policy.

14) Third-Party Services

We may use third-party printers, carriers, and payment processors to fulfill your order. Your use of those services may be subject to their terms and policies.

15) Limitation of Liability

To the maximum extent permitted by law, PortraitBrush and its directors, employees, and contractors are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or revenues, arising from your use of the site or products. Our total liability for any claim relating to an order will not exceed the amount you paid for that order.

16) Indemnification

You agree to indemnify and hold PortraitBrush harmless from claims arising out of your breach of these terms or your misuse of the services, including claims that your uploaded content infringes the rights of others.

17) Force Majeure

We are not responsible for delays or failures caused by events beyond our reasonable control, such as natural disasters, labor disputes, carrier disruptions, or governmental actions.

18) Changes to the Service or these Terms

We may update these Terms at any time. The “Last updated” date will reflect the current version. Continued use of the site after changes means you accept the updated Terms.

19) Governing Law and Dispute Resolution

These Terms are governed by the laws of Colorado/United States, without regard to conflict of law rules. Any dispute will be resolved in the courts of Colorado/United States, unless otherwise required by law. If you prefer arbitration or another mechanism, contact us to discuss.
